Terms of service

Terms and conditions

1. Scope

These terms and conditions apply to all orders placed by consumers through the Elovium online shop at elovium.com.

Your contracting party is:

Paul Fröhlich
Salemer Steig 20
14163 Berlin
Germany
Email: info@elovium.com

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Formation of the contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By submitting an order through the online shop, the customer makes a binding offer to purchase the selected goods.

After the order has been received, the customer receives an automatic order confirmation by email. This confirms receipt of the order and does not yet constitute acceptance of the offer, unless it expressly states that the order has been accepted.

The purchase contract is formed when we accept the order by an express order acceptance or dispatch the ordered goods to the customer.

If, exceptionally, a product is unavailable, we will inform the customer. Any payment already made will be refunded without undue delay.

3. Prices and payment terms

All prices stated in the online shop are total prices and include statutory VAT where applicable.

Any additional shipping costs are shown in the relevant offer and before the order is completed.

The available payment methods are displayed in the online shop during checkout.

Payment is due immediately when the order is completed, unless otherwise stated for the selected payment method.

4. Delivery and shipping

Delivery is made to the shipping address provided during checkout.

The applicable delivery times and shipping costs are stated in the online shop and before the order is completed.

If delivery is delayed by circumstances beyond our control, we will inform the customer.

Partial deliveries are permitted where reasonably acceptable to the customer.

5. Retention of title

The goods remain our property until the purchase price has been paid in full.

6. Right of withdrawal

Consumers have a statutory right of withdrawal.

Details of the right of withdrawal, the withdrawal period and the effects of withdrawal are set out in our withdrawal policy.

7. Liability for defects

The statutory provisions on liability for defects apply.

In the event of defective goods, the customer has the statutory rights to supplementary performance, withdrawal from the contract, a reduction in price and, where applicable, damages.

These terms and conditions do not restrict the customer's statutory rights in respect of defects.

8. Liability

We are liable without limitation for damage caused by an intentional or grossly negligent breach of duty.

Our liability for injury to life, body or health is also governed by the statutory provisions.

In all other respects, the statutory provisions on liability apply.

9. Product use and care

Our jewellery is made from Grade 5 titanium and is intended for normal use as jewellery.

Customers should follow the relevant care and product instructions.

Damage or alteration to goods caused by improper handling, exceptional mechanical stress or use other than as intended may leave statutory liability for defects unaffected, insofar as the statutory requirements for this are met.

10. Applicable law

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

11. Dispute resolution

We are not obliged and are generally not willing to participate in dispute resolution proceedings before a consumer arbitration body.

The possibility of alternative dispute resolution remains unaffected.

12. Final provisions

If individual provisions of these terms and conditions are or become invalid, the remaining provisions remain unaffected. The statutory provisions take the place of any invalid provision.
